The Shire of Capel is in the process of reviewing its existing Town Planning Scheme No. 7 by concurrently preparing a Local Planning Strategy and new updated Local Planning Scheme No. 8. Both of these important planning documents are proposed to be prepared and introduced following consultation with the community and government agencies.

What is a Local Planning Scheme?
A Local Planning Scheme is a statutory planning document that zones land and includes mandatory and discretionary development control provisions to guide development within the Shire of Capel. The new Local Planning Scheme for the Shire proposes to implement the short term objectives of the proposed Local Planning Strategy.
Why does the Shire need to update Town Planning Scheme No.7?
Introduced in 1999, Town Planning Scheme No. 7 has been subject to a number of updates (Scheme Amendments). A more comprehensive review is now required to meet statutory requirements for the review of Local Planning Schemes.
New Local Planning Scheme No. 8 is proposed to be compliant with the recently introduced Planning and Development (Local Planning Schemes) Regulations 2015. While Local Planning Scheme No. 8 is proposed to reflect the existing strategic local and regional planning framework, it provides an opportunity to improve planning outcomes and assessment efficiencies.
What is a Local Planning Strategy?
A Local Planning Strategy will provide a strategic long term (15 years) planning direction for land use planning in the Shire of Capel. The Local Planning Strategy is proposed to reflect the existing regional and local planning framework, provide the rationale for proposed zones and identify key planning issues to be addressed by the new Local Planning Scheme.
Why does the Shire need a Local Planning Strategy?
The Shire has a well-developed strategic local planning framework that provides for future growth and development in the form of:
- townsite strategies for the Capel, Boyanup and Peppermint Grove Beach settlements;
- Shire of Capel Land Use Strategy;
- structure plans for urban expansion area within Capel, Boyanup and Dalyellup; and
- a range of supporting technical studies.
The Shire proposes to consolidate and update the above local planning framework within a single Local Planning Strategy. This outcome is also in accordance with the statutory requirements of the Planning and Development (Local Planning Schemes) Regulations 2015.
How long will it take for the new Local Planning Scheme and Local Planning Strategy to be introduced?
The Shire envisages it will take between two to three years (from October 2015) to prepare and obtain approval for the Local Planning Strategy and new Local Planning Scheme. This short timeframe may be subject to variation due a range of factors including the time required to undertake research and preliminary consultation, preparation of draft documents, Council consideration, advertising, the need to address any issues raised during advertising and the need to obtain state level approvals.
Will the new Local Planning Scheme and Local Planning Strategy be advertised for community comment?
Yes. The Shire will undertake advertising of the new Local Planning Scheme and Local Planning Strategy for public comment once Council has received all required state level approvals of draft documents.
